THE JOB

What Does A Probate Judge Do?

The Beaufort County Probate Court Judge oversees guardianship, conservatorship, trust, estate, and therapeutic proceedings. Unlike judges in other courts, the Probate Judge is elected directly by the citizens of Beaufort County.  The Probate Judge is responsible for:

  • Issuing marriage licenses

  • Approving certain wrongful death settlements

  • Appointment of:

    • personal representatives
    • conservators and guardians

  • Involuntary commitment of persons who are deemed mentally ill, intellectually  disabled, and chemically dependent

  • Conducting hearings and trials in formal proceedings

  • Processing and admitting to wills to probate 

  • Maintenance of public records
